Thanks for using our products and services ("Services"). getAddress() is operated by GetAddress LLC, a Delaware limited liability company ("we", "us"). By using our Services, you are agreeing to these terms. Please read them carefully.
Using our Services
You must follow any policies made available to you within the Services. Don't misuse our Services. For example, don't interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct. Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. These terms do not grant you the right to use any branding or logos used in our Services.
Usage Limits
Attempts to download the whole or large sections of our data-set for off-line use will result in your account being closed.
Load testing our live servers will result in your account being closed.
The Autocomplete API must be requested by human input. Automated address lookups with this API will result in your account being closed.
Address Data Licence
Our address data contains data sourced from the LINZ Data Service licensed for reuse under CC BY 4.0. If you publish address data obtained from our Services, credit ToitÅ« Te Whenua Land Information New Zealand (LINZ) as that licence requires. Postcodes are not LINZ data and are not NZ Post’s: they come from open_nz_postcodes (CC0), are unofficial, and are wrong for about 5% of addresses. Each address says how its postcode was assigned. See our attribution page for the full statement.
Postcode Corrections
You can tell us when an address has the wrong postcode, one address at a time, through the API, your console or our widget. By sending a correction you confirm that:
- it comes from your own knowledge or your customer’s, for example the person who lives at the address or mail returned to you, and not from any NZ Post product or service, including its Postcode Address File, its Postcode Network File and its online postcode finder;
- you have the right to give it to us, and you license it to us free of charge, for ever, to use, change and publish as part of our address data.
Corrections are reviewed before they are used, and we may reject any of them. We limit how many you can send each day, and we may pause corrections from any account whose submissions look copied or automated and reject them all. Sending corrections is free, does not count as a look-up, and is not required to use our Services.
Reselling
You cannot resell access to our Services without explicit permission. Attempts to create a paid proxy to our Services will result in your account being closed.
Price Increases
We guarantee that during the subscription's first 12 month period you will be protected against any price increases.
Privacy and Copyright Protection
By using our Services, you agree that we can use such data in accordance with our privacy policies. We respond to notices of alleged copyright infringement and terminate accounts of repeat infringers. If you think somebody is violating your copyrights, please notify us.
Modifying and Terminating our Services
We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether. You can stop using our Services at any time, although we'll be sorry to see you go.
Liability for our Services
WHEN PERMITTED BY LAW, WE WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. Address data is provided as it is. Neither we nor LINZ warrant that it is accurate or complete, and postcodes in particular are unofficial.
Rate Limiting
A rate limit ensures our platform is not flooded with too many requests. Your subscription's plan sets the number of requests allowed per 5-minute span; exceeding it returns a HTTP 429 response with a Retry-After header. Continuously ignoring our rate limit may result in the suspension of your account. To ensure the quality of our service, we may change the rate limit at anytime without notice.
About these Terms
We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. We'll post notice of modifications to these terms on this page. We'll post notice of modified additional terms in the applicable Service. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service. These terms control the relationship between us and you. They do not create any third party beneficiary rights. If you do not comply with these terms, and we don't take action right away, this does not mean that we are giving up any rights that we may have (such as taking action in the future). If it turns out that a particular term is not enforceable, this will not affect any other terms.
By accessing or using our services, you acknowledge and agree that these Terms of Service are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Nothing in these terms excludes, restricts or modifies any right or remedy you have under a law that cannot be excluded, such as the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 of New Zealand.
